These terms govern your use of digitalchk.com and the free tools published on it. They are written to be read, not to be survived. If something here is unclear, write to us and we will explain it in plain words.
The short version. The free tools are exactly that: free, provided as they are, and meant to inform you rather than to decide for you. Run them only against domains and addresses you own or are authorized to assess. Anything a report suggests, especially a DNS record, should be checked before you apply it. Using a tool does not make us your IT provider, and paid services are covered by a separate agreement, not by this page.
Who you are agreeing with
Digital Checkmark LLC, an IT and cybersecurity services company based in Tampa, Florida, United States. In these terms, “we” and “us” mean Digital Checkmark LLC, and “you” means the person or organization using this website.
By using this site or any tool on it, you accept these terms. If you do not accept them, please do not use the site.
What these terms cover
This page covers the website and the free tools. It does not cover our paid services. Managed IT, security, continuity and any other engagement is governed by the written agreement signed for that work, which takes precedence over anything on this page.
Each free tool also shows its own specific terms at the point where you use it, describing what that tool queries and what it stores. Those tool specific terms apply in addition to these, and where a tool’s terms are more specific, the tool’s terms govern that tool.
The free tools
What they are for
The tools exist to give you a straight answer about something concrete: whether an address appears in a known breach, whether a domain’s email authentication is configured correctly, whether a message shows the markers of phishing, and so on. They produce information. They do not produce decisions, and they are not a substitute for professional judgment applied to your situation.
Nothing a tool returns constitutes legal, regulatory, financial or professional security advice, and a result should not be the only basis for an important decision.
Use them only where you are allowed to
You may use the tools for lawful purposes, on domains, addresses and messages that you own or that you are authorized to assess. Do not use them to profile, probe or gather information about people or organizations without a legitimate reason to do so.
You also agree not to:
- Automate, script or scrape the tools, or use them at a volume that a person could not reach by hand
- Circumvent the anti-bot check, the email verification step, or any usage limit
- Resell the tools or present their output as your own product
- Attempt to reach parts of the site or its infrastructure that are not published
- Use the tools in a way that breaks the terms of the upstream data sources named in our privacy policy
We can restrict or block access that breaks these rules, and we do not owe an explanation before doing so when the traffic is clearly abusive.
Accuracy, and what we cannot promise
The tools depend on data that belongs to other people. Breach records, ransomware victim disclosures, URL reputation and public DNS all come from outside sources that we do not control and cannot correct. A result can be incomplete, out of date, or wrong, and the absence of a finding is not proof that nothing is wrong.
We are also explicit about one thing that is easy to misread: a tool reporting no problem means the tool found no problem with the checks it performed. It does not mean you are secure.
Reports written with AI
Some reports include an explanation and an action plan written by an AI model from the technical findings. These are labeled as such. Any DNS record a report suggests carries a warning to validate it before publishing, and that warning is there because it is meant seriously: a wrong DNS record can stop your mail from being delivered. Check every suggested value against your own configuration before you apply it, or ask someone who can.
Availability
The free tools are offered without any uptime commitment. They depend on outside services, and when one of those is unavailable the tool will tell you so rather than invent a result. We may change, limit or withdraw any free tool at any time.
For our paying clients, availability and response times are defined in their agreement. As a general note, our automated monitoring and containment run continuously, and human response is available from 8am to 8pm Eastern Time.
Using a tool does not make us your provider
Running a free tool, receiving a report, or writing to us does not create a client relationship, a retainer, or any duty of care beyond what is described here. A working relationship begins when both sides sign an agreement for specific work.
Your content
When you submit something to a tool, such as an email file for analysis or a domain to check, you keep ownership of it. You confirm that you have the right to submit it. We use it to produce your result and, as described in our privacy policy, we do not retain the content of analyzed messages afterwards.
Our content
The text, design, code, articles and tools on this site belong to Digital Checkmark LLC, except where a third party is credited. You may read, quote and link to our articles with attribution. You may not copy the tools or republish substantial parts of the site as your own.
The reports a tool generates for you are yours. Use them, share them internally, give them to your auditor.
Limitation of liability
The free tools are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or accuracy.
To the maximum extent the law allows, we are not liable for indirect, incidental, special or consequential damages arising from your use of this site or the free tools, including lost profits, lost data, or business interruption. Where liability cannot be excluded, it is limited to one hundred dollars (USD 100) for matters relating to the free tools.
This section does not limit liability for fraud, for willful misconduct, or for anything that cannot lawfully be limited. Nor does it affect the terms of a signed services agreement, which has its own provisions.
Links to other sites
We link to outside references, documentation and data sources. We do not control those sites and are not responsible for their content or their practices.
Changes
We may update these terms. When we do, we will change the date at the top of this page. If a change materially affects how the tools may be used, we will say so plainly rather than editing the text quietly. Continuing to use the site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law rules. Any dispute relating to this site or the free tools will be brought in the state or federal courts located in Hillsborough County, Florida.
If any part of these terms is found unenforceable, the rest remains in force.
